Terms and Conditions

Version 1.10 of 1 November 2026

What changes: In the Android app, guidance takes its location from Google Play Services, which find the signal sooner, and ‘Open in another app’ is gone.

This is an English translation provided for convenience. In case of any discrepancy, the Italian version prevails.

Preamble · Who provides the service

The OffMap service (www.offmap.eu, app.offmap.eu and the OffMap app for Android, hereinafter ‘the Service’) is provided by Federico Trenta, domiciled in Lodi (LO), who can be contacted at the email address support@offmap.eu (‘OffMap’ or ‘the Provider’). These General Terms govern every use of the Service; their version and date are shown at the top of this page.

Art. 1 · Nature of the service and AI disclaimer

1.1 OffMap is a software platform for consulting, planning and generating digital map itineraries for riding on unpaved roads. The Service aggregates data from open sources (OpenStreetMap; the European Environment Agency’s Natura 2000 sites, licensed under CC BY 4.0) and reprocesses it through proprietary algorithms to return tracks in GPX format.

1.2 OffMap is not a life-saving satellite navigation device, is not a safety device and does not provide guiding or on-the-ground assistance services.

1.3 (Use of Artificial Intelligence models and OSINT) The platform includes an automated search and processing feature based on Artificial Intelligence (‘AI agent’), reserved for the Explorer Plus plan and started only at the user’s explicit request for a single road network, which summarises public information about the area, including whether roads are open to traffic, environmental restrictions and municipal or VASP (Viabilità Agro-Silvo-Pastorale, agricultural, forestry and pastoral roads) ordinances. The sources actually consulted are shown with their link; where there is no relevant source, the status of the network remains ‘unknown’.

1.4 (Probabilistic nature of AI data) The user acknowledges and expressly accepts that the AI agent’s answers and the information on prohibitions, protected areas, regional rules, gates, barriers and fords and the reports made by users (closed or open gates, obstacles, fords, pedestrian gaps, cattle grids, obstacles no longer there) are purely informative, indicative and probabilistic in nature. A gate reported as open does not authorise access and one reported as closed is not a prohibition. AI and scraping algorithms may produce inaccuracies, omissions or out-of-date information (‘hallucinations’). The sentences on regional laws are summaries written by OffMap from the text in force on the date of checking: they do not cover exemptions, local regulations or permits, they are not legal advice and for some regions none is given. OffMap does not guarantee the legal correctness, currency or completeness of the ordinances analysed by the AI. It is solely the user’s responsibility to verify on site whether prohibitions and permitted access actually exist, and to check the legal validity of ordinances with the competent authorities.

1.5 (Android app) The OffMap app for Android gives access to the Service with the same account and guides the user along an itinerary, a network or a GPX file, even without a connection; with a connection it also takes the user, on paved roads, from their location to the track or to a chosen point, and works out a new road if they leave it. When open roads do not reach the chosen join point, guidance may use mountain roads open only to permit holders, never limited traffic zones, pedestrian areas or roads closed to everyone: the stretch is marked in amber as ‘Permit-only road’ and holding the permit remains the user’s responsibility. If even this does not reach it, guidance leads to the nearest point a road reaches and from there shows the direction and distance of the last stretch, which is not on a paved road and may be travelled only where permitted. Nothing is purchased in the app: the Explorer Plus plan and single itineraries are purchased only on offmap.eu and also apply in the app. Guidance is an aid to reading the map: it does not signal bans, hazards or ground conditions and does not replace attention to the road; voice instructions and turns do not prevail over road signs or the Highway Code, and the paved route is calculated from map data that may be incomplete or out of date. The phone is consulted when stopped or mounted on the vehicle, in compliance with the Highway Code (art. 2). The guidance location comes from the phone’s location services (Google Play Services, where available) and may be inaccurate, especially indoors or just after starting: the app shows this with the accuracy circle and the words ‘Inaccurate GPS’.

Art. 2 · User obligations and assumption of risk

2.1 Physical signage, prohibition signs, actual ordinances and the ground conditions found on site prevail in all cases over any information, AI summary or GPX file provided by OffMap.

2.2 The user is solely and exclusively responsible for their riding conduct, for the decision to undertake a route, for the assessment of their own technical and physical abilities, and for the suitability of their vehicle.

2.3 The user undertakes to comply fully with the Italian Highway Code (Codice della Strada), the laws in force, and forestry, regional and municipal ordinances, and to respect private property and the environment. Any administrative penalties, fines for passing barriers or breaching VASP prohibitions, and damage to property or third parties resulting from travel in unauthorised areas are borne exclusively by the user, and OffMap is held entirely harmless and free from any liability.

2.4 Tracks are used entirely at the user’s own risk. OffMap, its creators, developers and partners cannot under any circumstances be held liable for injury to people or animals or damage to property, accidents, mechanical failures, penalties, or recovery or rescue costs arising from the direct or indirect use of the Service and of the routes generated.

Art. 3 · GPX tracks, single itineraries and downloads

3.1 On the Explorer plan the user downloads, free of charge, the GPX file of every single road network, including several networks together as separate tracks, and the track of an event made up of networks (art. 11), with no kilometre limit and subject to the technical limits of art. 7.2.

3.2 An itinerary is a single route that joins several networks with transfers, as a loop, one way or between a starting point and a destination (‘Route’). On every plan an itinerary can be built and previewed free of charge; downloading its GPX file requires the Explorer Plus plan (art. 4) or a single itinerary. A single itinerary is worth the download of one itinerary and is used up at the moment of the download: downloading the same file again from the personal history does not use another one, while every new download from the map, even of the same route, requires a new one.

3.3 A single itinerary is bought on the website and in the web app, at the price shown in the app and on the site at the time of purchase, through the external provider referred to in art. 4.2, or is received with a promo code (art. 14) or through the conversion in art. 3.4. Credit packs and top-ups are no longer sold.

3.4 Single itineraries have no expiry date, are strictly personal, cannot be transferred to third parties and cannot be converted into money; under no circumstances are they refunded or paid out in money. On the move to version 1.3 of these Terms, the credit balance of every user already registered is converted, once only, into single itineraries: one for every 10 (ten) credits, rounded up, and at least one even with a zero balance (for example 3 or 10 credits give 1 single itinerary, 11 credits give 2, 30 credits give 3). After the conversion the credit wallet no longer exists; anyone who signs up after the conversion receives no single itineraries this way.

3.5 The same rules apply to the track of an event published by another user (art. 11) and to an itinerary made public by another user: the track of an event made up of networks is free; the track of an event that is an itinerary is free for its organiser and for those who have joined, while for other users it requires, like another user’s public itinerary, the Explorer Plus plan or a single itinerary.

3.6 Stretches of dirt road downloaded stay unlocked for the user (they count towards the points of art. 11.4 and the map of unlocked stretches) and every file stays in the personal history, from which it can be downloaded again at no cost.

Art. 4 · Explorer Plus plan (renewal, cancellation and downgrade)

4.1 The user can take out a recurring subscription, monthly or annual, called the Explorer Plus plan, at the prices shown in the app and on the site at the time of subscription. The Explorer Plus plan includes: downloading every itinerary without single itineraries (including event tracks and other users’ public itineraries); consulting road status information through the AI agent (art. 1.3); recalculating individual connecting legs; saving itineraries in the profile; advanced route-building features (loop or one way, selection brush, cutting and removing stretches, manual ordering); publishing several active events at the same time, including with several networks or with an itinerary. With the Explorer plan, only one active event can be published at a time, with the track of a single network.

4.2 The subscription renews automatically at the end of the selected billing period. Payment is handled securely through an external provider (Stripe) and OffMap does not store the user’s full credit card details.

4.3 The user can cancel automatic renewal at any time from the subscription management portal provided by the payment provider (Stripe), which can be reached from their profile in the app. Cancellation stops future charges, but the Explorer Plus plan and its features remain active until the natural end of the period already paid for. The user receives an email confirming the cancellation with the end date of the plan and, if renewal is reactivated before that date, an email confirming the reactivation.

4.4 At the end of the validity period of the cancelled subscription, the account is automatically downgraded to the Explorer plan and the user is notified by email. Unused single itineraries and stretches already downloaded remain the user’s.

4.5 On sign-up each new account receives 30 (thirty) days of the Explorer Plus plan free of charge (“Plus Trial”), once per person, under the conditions of arts. 14.4 and 14.5; the same trial is given once to users already registered on the move to version 1.3 of these Terms who have never had the Explorer Plus plan. The Plus Trial can also be obtained or extended with a promo code (art. 14). It requires no payment method and does not renew.

Art. 5 · Exclusion of the right of withdrawal and refunds

5.1 Under art. 59, paragraph 1, letter o) of the Italian Consumer Code (Codice del Consumo, Legislative Decree 206/2005), the 14-day right of withdrawal is expressly excluded for the supply of digital content not on a tangible medium.

5.2 When purchasing a single itinerary or subscribing to the Explorer Plus plan, the user expressly requests that performance of the contract begin immediately (the single itinerary is added to the account and the plan’s features activated straight away) and acknowledges that, once performance has begun, they lose the right of withdrawal; this acknowledgement is requested and recorded on the purchase screen. No refund, full or partial, is given for single itineraries purchased or for subscription periods already paid for.

Art. 6 · Intellectual property and licence of use

6.1 Except for freely and openly sourced material (such as the base map data), OffMap’s software infrastructure, route calculation algorithms, filtered database, graphical interface and operating logic are the exclusive property of the creators of the service.

6.2 When the user downloads an itinerary (GPX file), they receive a limited, personal and non-transferable licence of use, intended exclusively for recreational and private purposes.

6.3 It is strictly forbidden to use OffMap for commercial purposes, to resell downloaded files, to share them en masse on other platforms or to use them to build competing databases, applications or archives.

Art. 7 · Fair use and ban on mass extraction

7.1 The user undertakes to use the platform manually and naturally. The use of any automated system (such as bots, scripts, scrapers or spiders) intended to extract data, itineraries or technical information from the application en masse is forbidden.

7.2 The ‘unlimited’ features included in the Explorer Plus plan are subject to the principle of reasonable consumption (fair use). To protect the stability and speed of the system for everyone’s benefit, the application applies technical safeguard limits: a maximum number of road stretches that can be joined or processed in a single operation, and limits on the number of requests per unit of time per user and per IP address (for example for itinerary generation, the AI agent, reviews and events) and, for free network downloads on the Explorer plan, a maximum number of new networks that can be downloaded in a day and in a month. These limits are more than sufficient for any normal exploring use, but stop abnormal or abusive calculation attempts at the outset.

7.3 In the event of a breach of these rules, or of attempts to circumvent the security and charging systems, OffMap reserves the right to suspend or close the user’s account immediately, blocking access, without notice and without any right to refunds for active subscriptions or unused single itineraries.

Art. 8 · Availability of the service and changes

8.1 OffMap is provided ‘as is’. While all reasonable measures are taken to ensure continuous access to the platform, no guarantee is given of uninterrupted or error-free operation (100% uptime).

8.2 The service may suffer slowdowns, suspensions or interruptions due to software updates, routine and extraordinary maintenance, or force majeure beyond the developers’ control (e.g. failures of telecommunication networks, interruption of cloud providers’ services, cyber attacks). In such cases, the user is not entitled to any refund or compensation.

8.3 OffMap reserves the right to modify, suspend or permanently discontinue the platform or certain features of the service at any time. In the event of permanent discontinuation of the service, the user expressly accepts that they will not be entitled to any refund, full or partial, for Explorer Plus subscription periods already paid for and not used, nor for unused single itineraries.

Art. 9 · Privacy, third parties and cloud infrastructure

9.1 The user’s personal data (such as email address and browsing data) are processed in strict compliance with EU Regulation 2016/679 (GDPR), as set out in detail in the dedicated Privacy Policy, which forms an integral part of these Terms.

9.2 To provide the service, OffMap uses external tools and providers. In particular, the handling of payments and billing data is delegated entirely to specialised providers (such as Stripe), which act as independent data controllers. OffMap does not at any time store or process full credit card details.

9.3 (Hosting and data transfer) OffMap’s technical infrastructure and database are hosted on cloud servers provided by third parties. Data are stored and processed primarily within the European Union or the European Economic Area (EEA). Should data, for technical or operational reasons, transit through or reside on servers located outside the EEA, such transfer will take place exclusively to providers that guarantee adequate levels of protection compliant with the standards imposed by the GDPR.

Art. 10 · Applicable law and competent court

10.1 These General Terms are governed by Italian law.

10.2 For any dispute relating to the interpretation or performance of these Terms, if the user qualifies as a ‘Consumer’ (that is, acts for purposes outside any business, commercial, craft or professional activity they may carry on), territorial jurisdiction lies with the court of the place of residence or domicile of the Consumer, if located within the territory of the Italian State. In all other cases, the competent court with exclusive jurisdiction is that of Lodi.

Art. 11 · User content, events, points and challenges

11.1 (Content) The user can publish on the Service reviews with ratings and photographs, events with their description, questions and answers on events, reports on the road (closed or open gates, obstacles, fords, pedestrian gaps, cattle grids, obstacles no longer there) and itineraries made public (‘Content’). The user remains the owner of their Content and grants OffMap a non-exclusive, free-of-charge, worldwide licence to store, reproduce and display it to other users within the Service for as long as it remains published.

11.2 The user is solely responsible for the Content they publish and warrants that they have the right to publish it. It is forbidden to publish content that is unlawful, offensive or misleading, that infringes third-party rights (including copyright and privacy) or that concerns identifiable people without their consent. Every user can report an event or a piece of content; OffMap may remove any Content and, in the cases provided for in art. 7.3, close the account, including without notice.

11.3 (Events) The events published on the events board are organised by users and not by OffMap, which does not organise or take part in them and does not check the meeting point, the route, the date or the suitability of participants. Any messaging group (WhatsApp or Telegram) associated with an event is external to the Service, is created and managed by the organiser of the ride and is shown only to riders who have joined when the event reaches the minimum number of participants. Arts. 2 and 8 apply in full to the ride itself: OffMap is not liable for cancellations, delays, accidents, damage or penalties connected with an event.

11.4 (Points, levels, leaderboard and challenges) The Service awards points for activity (for example kilometres of new dirt road downloaded, reviews, events, daily sign-in), calculates levels and titles, publishes a leaderboard and runs periodic challenges among small groups of users. Points, levels, positions and challenge results have no economic value, are neither transferable nor convertible, and may be recalculated, suspended or reset by OffMap in the event of abuse, error or a change to the rules, without giving rise to any right to compensation.

Art. 12 · Account, age requirements and communications

12.1 Each person may have only one account, with truthful registration details. The user is responsible for keeping their password safe and for all activity carried out with their account; in the event of unauthorised use, they must notify OffMap without delay.

12.2 The Service is reserved for people who have reached 18 years of age. By signing up, the user declares that they are of legal age.

12.3 Service communications sent by email (confirmation and change of address, account security, payments and subscription, promo codes, invites and the free Explorer Plus period, events the user takes part in or organises, outcome of reports, changes to the Terms in the cases of art. 13.3) are part of the contract and do not require separate consent. Communications about news and offers are sent only with the user’s consent, which can be withdrawn at any time from the account settings.

12.4 The user can close their account at any time from the ‘Delete account’ item in the app’s Settings, confirming with their password. Closure immediately deletes the profile, content, history and unused single itineraries, including purchased ones (art. 3.4), cancels the events organised and cancels any Explorer Plus subscription with immediate effect, without refund of the remaining period (art. 5). The data kept after closure are set out in the Privacy Policy.

Art. 13 · Changes to the Terms

13.1 OffMap may change these Terms, for example to bring them into line with new features of the Service or changes in the law. Each version shows its number and date at the top of this page.

13.2 Changes are shown in the app at the first sign-in after they are published, with an invitation to read and accept them, and they take effect for a user from the moment that user accepts them; until then the previous Terms continue to apply to that user. Once 15 (fifteen) days have passed since publication, acceptance is required to keep using the account. For new users they apply from sign-up. A user who does not wish to accept them may close their account under art. 12.4.

13.3 If a change worsens the position of users with a paid Explorer Plus subscription in progress or single itineraries not yet used, for example on prices, renewal or included features, OffMap also notifies those users by email, and the change takes effect for them no earlier than 15 (fifteen) days after the email. Within 30 (thirty) days of the email the user may withdraw by writing to support@offmap.eu: by way of derogation from arts. 5.2 and 12.4, they receive a refund of the unused part of the subscription and of the single itineraries purchased and not yet used.

13.4 Purely formal corrections and changes required by law or in the user’s favour take effect on publication and are flagged in the app.

Art. 14 · Promo codes

14.1 OffMap may distribute promo codes, on their own or inside a link (app.offmap.eu/r/…), that give from 1 (one) to 10 (ten) single itineraries or a free period of the Explorer Plus plan (“Plus Trial”) of 30 days or, as a long trial, of 60 days. Each code belongs to a promotion with a reward, an end date and a maximum number of activations, which is a technical limit of the promotion. Codes are always free and are not tied to the purchase of single itineraries or of a subscription. A code distributed before version 1.3 that gave credits gives single itineraries instead, one for every 10 credits, rounded up.

14.2 A code is activated from the app with an account whose email address has been confirmed; if the address is not yet confirmed, the code stays pending and is activated when the address is confirmed, if it is still valid. Before activation the app shows the reward and the end date of the code; by activating the code the user accepts this article. Each person may activate only one code per promotion.

14.3 Single itineraries received with a code follow the rules of art. 3.4: they do not expire, are personal, and cannot be converted into money or refunded. They can be activated during the Explorer Plus plan too and stay available for when the user goes back to the Explorer plan.

14.4 The Plus Trial is available once per person, for good, whether received on sign-up (art. 4.5) or with a code: it is not available to anyone who has already had the Explorer Plus plan, paid or as a trial, including with another account or after closing an account. For this sole purpose OffMap keeps a non-reversible fingerprint of the email address, as described in the Privacy Policy. A Plus Trial code cannot be activated while an Explorer Plus plan is already active, except for the long trial in art. 14.5.

14.5 The Plus Trial is free, requires no payment method and does not renew. The long trial brings a Plus Trial in progress, including the one received on sign-up, to 60 days from its start; to anyone who has never had the plan it gives 60 days from activation; it cannot be activated after the Plus Trial has ended or during a subscription. During the trial the features of art. 4.1 and the limits of art. 7.2 apply; stretches downloaded during the trial stay unlocked afterwards, in accordance with art. 3.6. At the end of the trial the account automatically goes back to the Explorer plan, with the same effects as the downgrade in art. 4.4. OffMap notifies the user by email at the start of the trial, three days before the end and at the end. Anyone who subscribes to Explorer Plus during the trial starts paying at the end of the trial, if at least 48 hours remain until then; otherwise the subscription starts straight away.

14.6 Selling codes or transferring them for consideration is prohibited. Third parties, such as business partners or event organisers, may distribute codes only under a written agreement with OffMap; anyone who ties a code to their own purchase or prize promotion is directly responsible for it.

14.7 In the event of abuse, for example several accounts for the same person, codes obtained or used fraudulently or automated attempts to guess codes, OffMap may cancel the single itineraries or the Plus Trial obtained, in addition to the measures of art. 7.3. OffMap may deactivate early a code or a promotion that was distributed by mistake or outside the intended channels; activations already made remain valid, except in the case of abuse.

Art. 15 · Invites

15.1 OffMap may offer every user with a confirmed email address a personal invite link (app.offmap.eu/i/…), to share with other people. Anyone who signs up to OffMap from that link and confirms their email address receives 2 (two) single itineraries. At the same time the person who invited them receives 2 (two) single itineraries or, if they have a paid Explorer Plus subscription in progress, one month of the Explorer Plus plan under the conditions of art. 15.3. Taking part is free and is not tied to any purchase.

15.2 The person who invites receives a reward for at most 5 (five) people, for good, even when changing plan. Beyond that number the link remains valid and anyone who signs up still receives their single itineraries. The reward of the person who signs up is available once per person, for good: it is not available to an email address that has already brought an invite reward, including after an account has been closed, nor to anyone who has already had the Plus Trial with another account. No reward is due to anyone who signs up from their own link. For these sole purposes OffMap keeps a non-reversible fingerprint of the email address, as described in the Privacy Policy.

15.3 The month of Explorer Plus for the person who invites moves the date of the next subscription renewal forward by 30 (thirty) days, through the payment provider (art. 4.2) and without any charge. If a cancellation is in progress, it moves the end of the plan forward by 30 days. If, when the month is applied, the subscription is no longer active, 2 (two) single itineraries are due in its place. Anyone on the Plus Trial or with a free period of Explorer Plus received in another way receives single itineraries.

15.4 Single itineraries received with an invite follow the rules of art. 3.4: they do not expire, are personal, and cannot be converted into money or refunded. They are used before purchased ones.

15.5 OffMap does not send messages to the people invited and does not receive their addresses: the user shares the link in whatever way they prefer. Spreading the link through unsolicited bulk messages, and selling it or transferring it for consideration, are prohibited. By sharing their link the user accepts this article.

15.6 In the event of abuse, for example several accounts for the same person (art. 12.1), email addresses created to obtain rewards or automated invites, OffMap may cancel the single itineraries and the months of Explorer Plus obtained, in addition to the measures of art. 7.3. OffMap may change or suspend invites for the future; rewards already received remain, except in the case of abuse.
